TERMS AND CONDITIONS

1.
Terms and Conditions of the 2005.global online store constituting the terms and conditions for the provision of electronic services.

These Terms and Conditions (hereinafter: the “Terms and Conditions”) define the rules for concluding and performing agreements for the provision of electronic services and sales agreements in the online store https://2005.global, as well as the rights and obligations of the parties to those agreements.

The 2005.global online store (hereinafter: the “Store”), referred to in point 1.1, is available to all persons (hereinafter: “Users”) at: https://2005.global.

The owner of the Store (hereinafter: the “Seller”) is 2005 Sp. z o.o., with its registered office at ul. Nowa 23, 05-500 Stara Iwiczna, NIP 951-245-79-77, REGON 369720731.

The Seller’s contact details enabling Users to contact the Seller effectively are:

Agreements for the provision of electronic services and sales agreements are concluded with the Seller through the Store.

7.
The subject of the Seller’s business activity is the sale of clothing, accessories and jewelry (hereinafter: the “Products”).

The Store enables:

  1. obtaining information about Products that may be purchased through the Store,
  2. placing orders (hereinafter: “Orders”) by Users (hereinafter referred to as “Buyers”),
  3. browsing the website in a mobile version for Users using mobile devices.

For the purposes of these Terms and Conditions, the term “Consumer” shall mean, in accordance with Article 22¹ of the Civil Code, a User who is a natural person entering into a legal transaction with the Seller not directly related to their business or professional activity.

In order to place an Order, it is necessary to accept the Terms and Conditions by ticking the appropriate checkbox in the Order form.

11.
Using the Store itself does not require the User to incur any fees.

12.
Orders in the Store may be placed by natural persons, legal persons, and organizational units without legal personality to which the law grants legal capacity.

13.
Orders in the Store may be placed using the form, without the need to register in the Store.

14.
Acceptance of the Terms and Conditions is required in order to place an Order.

15.
Orders must contain the following data:

  1. first and last name (or company name, in the case of companies) of the User placing the Order,
  2. delivery address,
  3. email address,
  4. telephone number,
  5. name and quantity of the ordered Products,
  6. NIP / tax identification number (in the case of companies),
  7. selected delivery method,
  8. selected payment method.

The Order placement procedure is completed each time by the User successfully clicking the “Place order” button, which is equivalent to confirmation by the User that the Order form has been completed correctly and that the User is aware that fulfillment of the Order entails an obligation to pay, including the selected delivery costs.

If the Order form has been completed incorrectly, the Buyer may make changes by telephone or email, or cancel the Order entirely, provided that it has not yet been shipped.

After placing the Order, a message confirming that the Order has been placed by the User is immediately sent to the email address provided in the form.

The agreement is concluded when the Seller informs the Buyer that the Order has been accepted for processing. Such confirmation will be sent by email.

20.
The Seller may suspend acceptance of an Order in the event of doubts as to the truthfulness or reliability of the data provided by the Customer in the registration form. In such a case, the Seller will promptly contact the Customer in order to clarify such doubts.

If the products included in the Order are unavailable, the Seller will inform the Buyer of the impossibility of fulfilling the Order and will agree with the Buyer on the method of refunding the amount paid. If the impossibility of fulfilling the Order concerns only temporary unavailability of the products, the Seller will inform the Buyer of the potential date of fulfillment of the Order by telephone or email sent to the address provided by the Buyer in the Order form.

At the Buyer’s request, indicated by ticking the appropriate checkbox when completing the registration form, the Seller, after the payment has been credited to its account, will provide the Buyer with a VAT invoice — in the package or by email.

The Buyer may optionally add comments to their Order.

24.
Orders are fulfilled in the order in which they are placed.

25.
Product prices are given in Polish zloty (PLN) and are gross prices. It is also possible to change the currency to US dollars (USD) or euro (EUR). The Product prices stated in the Store do not include delivery costs. The total cost of the Order, including delivery costs, will be provided to the Buyer before final placement of the Order, by clicking the “Place order” button.

The Buyer may choose from the following online payment methods:

  1. PayPal
  2. Przelewy24
  3. BLIK
  4. Klarna
  5. Card payment

27.
Credit card and electronic transfer transactions are processed via the websites przelewy24.pl and paypal.pl.

28.
Payment for the ordered Products should be made by the User within 3 business days from the conclusion of the agreement.

29.
The Seller provides a receipt or (optionally) a VAT invoice together with the Product.

30.
The Seller reserves the right to change prices and delivery costs, in particular in the event of changes in the price lists of services provided by the entity performing deliveries. This point does not apply to Orders already being processed.

31.
Delivery is available within Poland as well as to countries of the European Union. Shipment to countries outside the European Union is possible after prior agreement with the Seller on delivery costs.

32.
Orders are shipped within 2 business days from the moment payment is received. If a given Product is announced as a Restock, shipping may be extended to up to 5 business days, and such information will be included in the Product description.

33.
Delivery is carried out from Monday to Friday, excluding public holidays.

34.
Products ordered by the Buyer are delivered via InPost courier service or to parcel lockers.

35.
For some international shipments, the carrier may be a courier company other than the one listed in point 4.4, and the Order fulfillment time may be extended.

36.
The delivery cost will be indicated each time during the Order placement process.

37.
In accordance with Article 27 of the Consumer Rights Act of 30 May 2014, a Consumer purchasing a Product in the Store has the right to withdraw from the distance agreement within 14 days from the date of delivery of the Product, without incurring any costs other than the direct cost of return shipping.

To make a return, the Consumer should fill out the return form included in the package. If the Consumer does not have the form, they may print any return form or write their details on a piece of paper. The Product should be packed together with the form and returned to the address indicated below.

The Consumer may also use the online return platform by selecting our company and completing the online form: https://wygodnezwroty.pl/2005. In that case, no paper version needs to be included.

38.
A receipt or invoice should be attached to the Product, if one was included with the Order.

39.
The Product must not show any signs of use.

40.
The Consumer returns Products at their own risk and cost.

41.
If the right of withdrawal is exercised, the Seller shall refund to the Consumer all payments made, including the cost of delivery, promptly and no later than within 14 days from the date the returned package is delivered to the Seller’s office, using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to another method of refund.

If an invoice was attached to the Order, a correcting invoice will be issued and should be signed and returned to the office at the address provided above.

If a free gift was included with the Order, the gift must also be returned together with the returned Product.

42.
The right of withdrawal referred to in point 6.1 does not apply to Products made to an individual order, in accordance with Article 38 of the Consumer Rights Act.

43.
With respect to Consumers, the Seller undertakes to deliver Products free from defects.

44.
Underwear, perfumes and condoms are not eligible for return or exchange.

45.
The Buyer has the right to file a complaint.

46.
With respect to Consumers, the Seller undertakes to deliver Products free from defects.

47.
The Seller does not provide a warranty for its Products.

A purchased Product may be subject to complaint within two years from the date of receipt if the following is found:

  • a defect,
  • incompleteness,
  • inconsistency with the description.

A Product may also be subject to complaint if it does not meet the Buyer’s expectations due to a defect arising during production. In such a case, the producer may, at its discretion, repair the damage free of charge, replace the Product, or refund the money. The warranty does not cover Products damaged due to improper care, negligence, ordinary wear and tear, washing, or natural processes resulting from prolonged use.

48.
The Seller reserves the right to allow size differences in clothing Products of up to 3 cm compared to the dimensions stated on the website.

49.
If the Buyer receives a defective Product, they may request removal of the defect or replacement of the item with one free from defects.

50.
A complaint does not require any special form, but it should contain:

A. data enabling identification of the User,
B. identification of the Product to which the complaint relates,
C. justification indicating the irregularity of the Product.

The Product together with the complaint should be sent to:

Within 14 days of submitting the complaint, the Seller will respond to it and inform the Consumer about the further course of action.

53.
The Seller will make every effort to ensure that complaints are processed without undue delay.

54.
During the complaint procedure, the Seller may request additional explanations, documents, or verification of the circumstances underlying the complaint.

55.
After the complaint has been resolved, the Seller will inform the person submitting the complaint whether the complaint has been accepted or rejected. In the event of rejection, the information will include the reasons for the rejection.
